Kathleen Pasulka-Brown is a Partner in Pugh, Jones & Johnson's Litigation Practice Group. She practices in commercial, insurance coverage, energy and telecommunications, real estate and other areas of complex civil litigation.
Kathleen has extensive experience in general commercial litigation matters, particularly cases involving insurance coverage, and in regulatory proceedings involving energy and telecommunications. She regularly analyzes insurance claims to provide counsel regarding the availability of coverage under CGL, D/O, E/O, EPL and other policies. She has litigated first and third-party insurance claims for both public and private entities, including claims involving property damage, business interruption, bodily injury, personal and advertising injury, sexual molestation, securities violations, and violations of constitutional rights. Kathleen has conducted multiple investigations on behalf of a governmental entity to support the assertion of claims against directors and officers of failed financial institutions. She managed litigation involving the disposition of a large block of commercial assets purchased from a failed financial institution. Kathleen also has handled multiple appeals.
For her work in the telecommunications, Kathleen was listed in Chambers USA: America’s Leading Business Lawyers. Kathleen was named an Illinois Super Lawyer from 2009 through 2016 and named a Leading Lawyer, by Leading Lawyers Network, from 2011 through 2016.
Prior to joining the Firm, she was a Litigation Partner at the firm of Foley & Lardner.
Litigated insurance disputes involving coverage for property damage, bodily injury, trademark infringement and other advertising injury, fiduciary liability, theft, fire and water damages, and medical expenses.
Represented a major public utility in connection with audits of the reliability of its supply and delivery service; defended against claims asserted by the Office of the Attorney General; handled witness testimony and discovery in rate case proceedings; litigated customer complaint cases challenging billing and other business practices of both electric and gas utilities.
Represented both wireline and wireless telecommunications carriers in regulatory proceedings involving the negotiation and arbitration of interconnection agreements; an expedited complaint proceeding involving service quality issues; a proceeding to prevent a municipality’s attempt to prohibit wireless service; and a rulemaking to establish service quality standards, which culminated in two appeals to the Illinois Appellate Court for the Fourth District that Kathleen successfully resolved.
